maybe it might be better working with wmode set to 'opaque' rather than 'transparent', so u can keep the dynamic background colour to your preference while still having ur custom div layer overlapping ur flash video.

something like this

em bed wmode="opaque" src="..."...
param name="wmode" value="opaque"
